A deepfake is a type of synthetic media created using artificial intelligence, typically deep learning techniques, to realistically alter or generate images, videos, or audio of people. The technology can superimpose one person’s face onto another’s body, change expressions, or create entirely new content that appears authentic. While deepfakes have legitimate uses in entertainment, education, and filmmaking, they are frequently misused to create non-consensual intimate imagery, often called “deepfake pornography” or non-consensual intimate images (NCII).

Facts Behind Grok AI Deepfake Lawsuits

In late 2025, xAI (Elon Musk’s artificial intelligence company) released enhanced image-generation capabilities for its Grok chatbot, including a “Spicy Mode” that allowed paying users to generate more explicit content. Users quickly discovered they could upload photos or describe real people to create sexualized deepfakes, including “undressing” images. Reports indicated Grok generated millions of sexualized images in a short period, with tens of thousands allegedly depicting children.

Key allegations in the lawsuits include:

  • xAI knowingly designed Grok with weak safeguards, prioritizing “maximum truth-seeking” and user engagement over safety.
  • The system prompt allegedly assumed “good intent” even with risky prompts involving “teenage” or “girl.”
  • xAI failed to implement industry-standard filters used by competitors to block child sexual abuse materials (CSAM) and non-consensual intimate imagery.
  • Promotional actions by Elon Musk and the platform allegedly amplified the issue.

Multiple lawsuits have been filed, including:

  • A class action in California on behalf of victims whose images were turned into explicit content.
  • A lawsuit by Ashley St. Clair (mother of one of Musk’s children) over deepfakes of herself, including some based on childhood photos.
  • Suits by three Tennessee teenagers alleging creation of child sexual abuse material.
  • A recent June 2026 suit by British lawmaker Jess Asato over sexualized images of her.

New and Changed Laws Around Deepfakes

The surge in AI-generated deepfakes has prompted rapid legislative responses:

  • Federal Level: The TAKE IT DOWN Act (Tools to Address Known Exploitation by Immobilizing Technological Deepfakes on Websites and Networks Act), signed into law in May 2025, requires online platforms to promptly remove non-consensual intimate images (including deepfakes) upon notice. It applies to both real and AI-generated content and provides civil remedies for victims.
  • State Level: As of 2026, nearly all states have enacted laws addressing non-consensual deepfake pornography. Many specifically target creation and distribution of intimate deepfakes, with increased penalties when minors are involved. Election-related deepfake laws have also expanded in over 30 states.
